Terms of Service

These Terms of Service ("Terms") govern your use of Orchard ("Service"), a dividend income tracking platform for South African investors, operated by Orchard SA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Description of Service
Orchard is a web-based application that allows users to track JSE-listed share holdings, project dividend income, and calculate South African dividend withholding tax (DWT). The Service pulls publicly available market data and does not constitute financial advice. Orchard is not a licensed financial services provider. Nothing on this platform should be construed as investment or tax advice.
2. Eligibility
You must be at least 18 years old and resident in South Africa (or otherwise legally permitted to enter into contracts in your jurisdiction) to use the Service. By using Orchard you confirm that you meet these requirements.
3. Subscriptions and Billing
Orchard offers the following plans:
- Free — R0: Up to 5 holdings at no cost, for as long as you wish. Subject to the fair use allowance below.
- Orchard Pro — R199/year: Everything in the Free plan, plus unlimited holdings, dividend email alerts, recording each purchase separately with its own date, the Dividend Income Summary PDF, and up to 3 portfolios in one account.
Fair use of the Free plan. The Free plan lets you track up to 5 holdings for as long as you like, at no charge and with no time limit. It also includes an allowance of 10 holding additions in total, which is deliberately double the 5 slots so that you have room to correct entry errors and change your mind while setting up your portfolio. Removing a holding is always free and unlimited. Once the allowance is used, your existing holdings continue to work exactly as before and you may still remove them; only adding new holdings requires a paid plan. This allowance exists so that the Free plan remains sustainable to offer, and is not intended to restrict ordinary use of the Service.
Paid plans are billed annually in South African Rand via PayFast. The annual fee is charged in full when you subscribe. Subscriptions renew automatically each year unless cancelled before the renewal date.
All prices include VAT where applicable. Pricing is subject to change with 30 days' notice.
4. Cancellation
You may cancel your subscription at any time by contacting us at hello@getorchard.co.za. Your access to paid features continues until the end of the current billing period. See our Refund & Cancellation Policy for full details.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of South African law.
- Scrape, copy, or redistribute data from the Service without written permission.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to transmit spam, malicious code, or disruptive content.
6. Intellectual Property
All content, design, code, and trademarks on Orchard are owned by or licensed to Orchard SA. You are granted a limited, non-transferable licence to use the Service for personal, non-commercial dividend tracking purposes. No rights are transferred to you beyond this licence.
7. Data Accuracy
Dividend data is sourced from publicly available market feeds (including Yahoo Finance). While we strive for accuracy, we do not guarantee that data is complete, current, or error-free. Do not make financial decisions based solely on projections shown in Orchard. Always verify dividend information with your broker and the relevant JSE company announcement (SENS).
8. Privacy and POPIA
We collect and process personal information (email address, portfolio holdings) to provide the Service. We comply with the Protection of Personal Information Act 4 of 2013 (POPIA). We do not sell your personal information to third parties. For full details, contact us at hello@getorchard.co.za.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any data shown is accurate or complete.
10. Limitation of Liability
To the maximum extent permitted by South African law, Orchard SA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of income or profits. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email to your registered address. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
